GENERAL TERMS AND CONDITIONS

These General Terms and Conditions contain the terms applicable to all services provided; the specific Product Terms and Conditions include additional terms for the particular Hosting Services you’re purchasing, as well as the Acceptable Use Policy. The agreement takes effect on the date of the email from 369Hosting expressly confirming the acceptance of your order or the date you agree to these terms and conditions.

DEFINED TERMS

Certain terms used in this agreement carry specific meanings:

“Acceptable Use Policy” or “AUP” refers to the 369Hosting Acceptable Use Policy.

“Affiliate” means any subsidiary or parent company of either party to this agreement, as well as any subsidiary of that parent company.

“Business Day” or “Business Hours” refers to 8:00 a.m. – 5:00 p.m. Monday through Friday, excluding public holidays in Kenya.

“Confidential Information” includes all data exchanged between us, whether before or after the agreement’s effective date, that should reasonably be understood to be confidential, such as:
(i) for you, information transmitted to or from, or stored on, your Hosted System;
(ii) for both of us, information clearly marked as confidential. However, information independently developed or available without breach of the agreement does not constitute “Confidential Information.”

“Country Specific Terms” refers to any legal addenda that apply if any of your services are provided outside Kenya.

“Hosted System” refers to a combination of hardware, software, and networking components making up the IT system you use. It may be a dedicated system for your use only or part of a shared system maintained by 369Hosting for multiple customers.

“Hosting Services” means:
(i) 369Hosting’s provision of the Hosted System as described in the Services Description, and
(ii) Support.

“Product Terms and Conditions” outlines the specific terms for the Hosting Services you’re purchasing.

“Services Description” refers to a written outline of the Hosted System and/or Supplementary Services you’re purchasing from 369Hosting, including fees, and forms part of this agreement, such as the “plan” submitted during the online order process.

“Service Level Guarantee(s)” refers to:
(i) any guarantee described as a “Service Level Guarantee” in the relevant Product Terms and Conditions, or
(ii) any provision offering a specific credit or financial remedy for failure to deliver services.

“Services” collectively refers to Hosting Services and Supplementary Services.

“Supplementary Services” are additional services from 369Hosting, such as time-based professional or consulting services, one-time or non-recurring services, and services outside regular support (like support for your hosted applications).

“Support” is defined in the applicable Product Terms and Conditions.

Domain Name Registration

369Hosting offers domain name registration and renewal services in collaboration with ICANN-accredited registrars. Promotional offers and special rates are available only to new customers for the initial term, and all domain registrations will renew at regular rates. Domain names set for automatic renewal will be renewed 6 days before expiry. Renewal and related costs are your responsibility. The client can opt in or out of automatic renewal via the Client Area. If your hosting plan includes a free domain, 369Hosting may renew it automatically as part of the plan, regardless of your renewal settings. Domain transfers are restricted for 60 days following the initial registration or successful transfer.

Termination / Plan Change / Refund Policy

369Hosting may terminate your service for reasons such as:
– Non-payment of fees
– Breach of terms or disruption to operations

In such cases, client data will be removed from 369Hosting servers. Account termination or hosting plan changes can be requested at any time by contacting Customer Service through phone or service tickets. Proper verification is required to process cancellations. Incomplete requests will be deemed invalid. No refunds are offered for monthly billed services or one-time fees. Refunds on non-monthly hosting services may be provided under specific conditions, such as within 30 days of account sign-up, service renewal, or plan change. However, fees for free domain registrations will apply if hosting is canceled early. Only one refund is issued per invoice, and domain registrations cannot be canceled before the end of their term.

Prohibited Conduct/Acceptable Use Policy (AUP)

369Hosting prohibits the use of unsolicited commercial email (“Spam”). Sending spam or hosting spam-promoting content may result in immediate suspension. Clients must comply with Kenyan laws and ensure resource usage does not disrupt the service. Prohibited content includes but is not limited to:
– Pornography or adult content
– Piracy-related information
– Spam-related promotions
– Offensive material, including racism or bigotry
– Exploitation of minors
– Illegal goods or services
– Copyright or intellectual property violations.
